These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client," "User," or "You") and Radiance Realty LLC ("Company," "We," "Us," or "Our"), a licensed real estate brokerage operating in the United States. These Terms govern your access to and use of our website, mobile applications, services, and all related communications.

By using our services in any capacity — whether by visiting our website, requesting property information, signing a buyer or seller representation agreement, or engaging our agents — you confirm that you are at least 18 years of age, have the legal capacity to enter into binding agreements, and accept these Terms without reservation.

Note: If you do not agree to any part of these Terms, please discontinue use of our services immediately. Continued use of our website or services constitutes ongoing acceptance of any revisions made to these Terms.

Services Provided

Radiance Realty provides premium real estate brokerage services, including but not limited to buyer representation, seller representation, property marketing, investment consultation, and property management facilitation. Our services are offered exclusively within jurisdictions where Radiance Realty holds valid, active licensure.

Our Core Services Include

  • Residential and commercial property buying and selling assistance
  • Luxury estate representation and bespoke property search services
  • Real estate market analysis, valuations, and comparative market reports
  • New development sales and off-market property access
  • Investment property acquisition strategy and portfolio consulting
  • Relocation services and neighborhood advisory for incoming residents
  • Negotiation, contract drafting guidance, and transaction coordination

Radiance Realty reserves the right to modify, expand, or discontinue any service at any time without prior notice, subject to any obligations created under signed representation agreements.

User Obligations

As a user of our website and services, you agree to use all features and resources in a lawful, ethical, and responsible manner. You are solely responsible for all activities conducted through your account or under your identity when communicating with Radiance Realty.

You Agree Not To

  • Provide false, misleading, or fraudulent information at any point during your engagement
  • Impersonate any person, entity, or licensed real estate professional
  • Use our platform or agents to facilitate money laundering, fraud, or any illegal transaction
  • Attempt to scrape, harvest, or systematically collect data from our website without written consent
  • Circumvent, disable, or interfere with security-related features of our website
  • Engage in any conduct that would bring disrepute or harm to the reputation of Radiance Realty

Violation of these obligations may result in immediate termination of service, legal action, and reporting to relevant regulatory authorities.

Property Listings & Information Accuracy

All property listings displayed on the Radiance Realty website are provided for informational purposes only. While we make every effort to ensure the accuracy and currency of listed information — including pricing, specifications, availability, and images — Radiance Realty makes no warranties, express or implied, regarding the completeness or accuracy of listing content.

Property prices, availability status, and detailed specifications are subject to change without notice. Listing photographs are representational and may not reflect the current condition of a property. Floor plans, square footage, lot dimensions, and HOA information should be independently verified by the prospective buyer prior to any offer or purchase.

Disclaimer: Radiance Realty shall not be held liable for any decisions made based solely on website listing content. All clients are strongly advised to conduct independent due diligence and engage qualified professionals including attorneys, inspectors, and financial advisors before completing any real estate transaction.

Intellectual Property Rights

All content published on the Radiance Realty website — including but not limited to written copy, photography, videography, graphics, logos, brand elements, market reports, design layouts, and software — is the exclusive intellectual property of Radiance Realty LLC or its licensed content providers, and is protected under applicable copyright, trademark, and intellectual property laws.

Permitted & Prohibited Use

  • You may browse and use our website solely for personal, non-commercial purposes
  • You may share listing links via social media for informational, non-commercial sharing
  • You may not reproduce, republish, distribute, or commercially exploit any content without written permission
  • You may not use the Radiance Realty name, logo, or branding in any form without express written authorization
  • Unauthorized use of our content may result in civil and criminal liability

Privacy & Data Protection

Radiance Realty is committed to protecting the privacy of all users and clients. The collection, storage, and use of your personal information is governed by our Privacy Policy, which is incorporated by reference into these Terms. By using our services, you consent to the data practices described in our Privacy Policy.

We collect personal information including but not limited to your name, contact details, financial qualification indicators, and property preferences, solely for the purposes of delivering our real estate services and improving your experience. We do not sell personal data to third parties. Information may be shared with affiliated service providers (e.g., title companies, mortgage brokers) only when necessary to facilitate a transaction you have initiated.

You have the right to request access to, correction of, or deletion of your personal data at any time by contacting us at privacy@radiancerealty.com.

Limitation of Liability

To the fullest extent permitted by applicable law, Radiance Realty LLC, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services or website, including but not limited to loss of profits, data, goodwill, or business opportunities.

In no event shall our total aggregate liability to you for all claims arising out of or related to your use of our services exceed the total fees paid by you to Radiance Realty in the twelve (12) months preceding the event giving rise to the claim.

Real estate transactions involve inherent financial and legal risks. Radiance Realty strongly recommends independent legal, financial, and structural inspections before completing any property transaction. We are not liable for market fluctuations, appraisal discrepancies, or third-party service failures.

Fees & Commission Structure

All commission rates, service fees, and compensation structures applicable to your specific transaction will be disclosed and mutually agreed upon in a signed Representation Agreement prior to the commencement of services. Radiance Realty operates in compliance with all applicable state real estate commission disclosure requirements.

General Fee Principles

  • Commission fees are negotiable and must be agreed upon in writing before representation begins
  • Buyer representation services may be offered at no direct cost to the buyer depending on transaction structure
  • Seller listing agreements will specify the full commission amount and any co-brokerage arrangements
  • Cancellation fees, if applicable, will be explicitly stated in your representation agreement
  • Consulting and advisory retainers for investment services are billed separately as agreed

Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or your use of Radiance Realty services, the parties agree to first attempt resolution through good-faith negotiation. You agree to notify Radiance Realty in writing of any dispute, providing reasonable opportunity to resolve the matter informally before pursuing formal proceedings.

If informal resolution is not achieved within thirty (30) days, the parties agree to submit the dispute to binding arbitration administered by the American Arbitration Association (AAA), in accordance with its Commercial Arbitration Rules, before a single arbitrator with expertise in real estate law. Arbitration shall take place in Beverly Hills, California, and the decision of the arbitrator shall be final and binding.

Class Action Waiver: By agreeing to these Terms, you waive the right to participate in class action lawsuits or class-wide arbitration proceedings against Radiance Realty.

Termination of Services

Either party may terminate an engagement by providing written notice as specified in the governing representation agreement. Radiance Realty reserves the right to terminate or suspend access to our services at any time, with or without cause, including cases of suspected fraud, material breach of these Terms, or conduct deemed harmful to our clients, agents, or business reputation.

Upon termination, all obligations created under any signed agreement that expressly survive termination shall remain in full force and effect, including confidentiality obligations, commission entitlements for protected transactions, and indemnification provisions.

Governing Law

These Terms and Conditions, and any disputes arising hereunder, shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to conflict of law provisions. For matters not subject to arbitration, the parties consent to exclusive jurisdiction and venue in the courts of Los Angeles County, California.

Radiance Realty also operates in compliance with the National Association of Realtors® Code of Ethics and all applicable federal, state, and local fair housing laws, including the Fair Housing Act, which prohibits discrimination in the sale, rental, and financing of housing based on race, color, national origin, religion, sex, familial status, and disability.

Amendments to These Terms

Radiance Realty reserves the right to amend, update, or revise these Terms and Conditions at any time at our sole discretion. All amendments will be effective immediately upon posting to our website. The "Last Updated" date at the top of this document will reflect the most recent revision date.

It is your responsibility to review these Terms periodically for any changes. Continued use of our services following any such modifications shall constitute your acknowledgment and acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify registered users via email or website notice.
